The Food and Drug Administration (FDA) rescinded its June 2022 ban on Juul Labs’s e-cigarettes.
While the FDA agency hasn’t yet reached a final decision on whether they can stay in the U.S. market, the move does open the possibility for federal clearance.
In 2022, the FDA ordered Juul to halt sales, then stayed the order pending the vaping company’s appeal. On Thursday, the agency placed Juul’s products back under scientific review, which ultimately moves them back to their regulatory status before the ban.
Reports state the decision by the FDA was made in part due to a new case law that has been established in lawsuits brought over other e-cigarette brands the agency has ordered off the market. In addition, the FDA stated that a further review of Juul’s submissions also contributed to the outcome of the appeal.
In a statement, Juul said: "We appreciate the FDA’s decision and now look forward to re-engaging with the agency on a science- and evidence-based process to pursue a marketing authorization for JUUL products."
The FDA didn’t provide a timeline for a final decision.
